The State Department for Internal Security and National Administration is seeking support from the Administration and Internal Security Committee to fast-track the operationalization of the Public Benefits Organization Act, 2013.โ€

In a session chaired by Hon. Gabriel Tongoyo ( Narok West), the Principal Secretary, State Department for Internal Security and National Administration, Dr. Raymond Omollo urged the Committee to support the Public Benefit Organizations Regulatory Authority ( PBORA) with resources to enable them to fast-track the operationalization of the Public Benefit Organization Act.

While making his presentation, the CEO of PBORA, Dr. Lexmana Kiptoo told the Committee that the Act was last repealed in 2013, since 1990.

โ€œWhile the Act was enached on 2013, it had not been operationalized up to May, 2024โ€, noted Dr. Kiptoo

He further said that since the Act became operational, the board changed its name from Non-Governmental Organizations Co-ordination Board to Public Benefit Organizations Regulatory Board.

โ€œWhile the Act became operational in May 2024, challenges still exist. For example, the regulations which are necessary for full implementation are yet to be enactedโ€, added Dr. Kiptoo

The document before the Committee revealed that the Authority embarked on harmonization of two drafting regulations which were drafted by the Civil society Organization and the Authority itself, following a court order which stopped the process.

The State Department further assured the Committee that for effective implementation of this Act, the Department and PBORA have come up with a process of harmonizing the two sets of regulations, through public participation, which will culminate into the regulations being gazetted.

The Principal Secretary appealed to the Committee to extend the time limit to a maximum of six months to enable them to finalize the process.

The Committee was also briefed by the Legal Counsel on the Assumption of the Office of the President and Transition of Executive Authority Bill, 2025, sponsored by Hon. Kimani Ichungโ€™wah.
